Rekacipta.co.id – Terms of Service

Welcome to Rekacipta.co.id, operated by PT Karsa Reka Cipta (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access and use of the Rekacipta.co.id website, services, applications, and marketplace platform (collectively, the “Platform”).

By registering for, accessing, or using the Platform, you (“User,” “Buyer,” or “Service Provider”) agree to comply with and be bound by these Terms. If you do not agree, you may not use Rekacipta.co.id.

1. Definitions

Buyer – Any user who purchases services, digital products, or physical products through the Platform.
Service Provider – Any Freelancer, Vendor, Integrator, or Agency offering services, digital deliverables, or physical products through the Platform.
Order – A contract between Buyer and Service Provider facilitated via Rekacipta.co.id.
Escrow – Payment protection mechanism where funds are held until order completion or dispute resolution.
Digital Services – Work products delivered electronically (e.g., design, software, writing, consulting).
On-Site Services – Work performed physically at a Buyer’s location (e.g., inspection, installation, integration).
Physical Products – Tangible goods sold through the Platform.

2. User Eligibility & Accounts

Users must be at least 18 years old and legally able to enter contracts.
Each user must create a unique account and provide accurate, complete, and updated information.
Users are responsible for safeguarding account credentials and all activities under their account.
Rekacipta.co.id reserves the right to suspend or terminate accounts for violations of these Terms.

3. Services Provided by Rekacipta.co.id

Rekacipta.co.id provides a marketplace platform for Buyers and Service Providers to connect, transact, and collaborate.

We are not a party to contracts between Buyers and Service Providers.
We do not guarantee the quality, safety, legality, or performance of services/products.
Our role is limited to providing technology, payment escrow, and dispute resolution.

4. Orders, Payments & Escrow

Buyers place Orders through the Platform and must fund them in advance.
Payments are held in escrow until:
- The Buyer approves delivery; or
- A dispute is resolved.
Service Providers receive funds only after completion approval.
Rekacipta.co.id charges 20% service fee deducted from payments.
All payments must be processed through the Platform — off-platform transactions are strictly prohibited.

5. Refunds, Returns & Disputes

Rekacipta.co.id operates under a fair resolution framework:

Digital Services & Products

Refunds for non-delivery, major deviation from agreed scope, or unusable/corrupted files.
No refunds for subjective dissatisfaction if work matches the agreed scope.

On-Site Services

Refunds for no-shows, failure to perform, or safety/regulatory violations.
No refunds if Buyer cancels after mobilization or if services were substantially performed.

Physical Products

Refunds/returns allowed for defective, damaged, or misrepresented goods.
Products must be returned unused, in original condition, within 7 days of delivery.
No refunds for perishable, sanitary, or customized items.

Dispute Process

Buyer must first request revision or replacement.
If unresolved, disputes may be escalated via Rekacipta’s dispute center.
Our decision is final and binding.

6. Service Provider Obligations

Service Providers must:

Deliver services/products as described in their listings.
Maintain professional standards, safety compliance, and applicable licenses.
Respect deadlines and communicate clearly with Buyers.
Not deliver plagiarized, fraudulent, or unsafe work.

7. Buyer Obligations

Buyers must:

Provide accurate project requirements and expectations.
Pay promptly through the Platform.
Not misuse delivered work or request refunds without valid grounds.
Treat Service Providers with professionalism and respect.

8. Fees & Taxes

Rekacipta.co.id charges service and transaction fees as published on the Platform.
Users are responsible for all applicable taxes, VAT, or withholding obligations under local law.

9. Prohibited Activities

Users may not:

Circumvent the Platform to avoid fees.
Engage in fraud, misrepresentation, or spam.
Upload or distribute illegal, offensive, or harmful content.
Infringe on intellectual property rights.
Harass, abuse, or discriminate against other users.

Violations may result in account suspension, order cancellation, and legal action.

10. Intellectual Property (IP)

Unless otherwise agreed, IP rights to completed digital work transfer to the Buyer upon full payment.
Service Providers retain portfolio rights to showcase completed work, unless confidentiality is requested.
Buyers must not use delivered work without completing payment.

11. Limitation of Liability

Rekacipta.co.id provides the Platform “as is” without warranties of merchantability, fitness, or accuracy.
We are not liable for damages, accidents, or losses resulting from user transactions, misuse of products, or services.
Maximum liability of Rekacipta.co.id is limited to the fees paid by the User in the past 6 months.

12. Indemnification

Users agree to indemnify and hold harmless Rekacipta.co.id, PT Karsa Reka Cipta, and its affiliates from any claims, damages, or liabilities arising from their use of the Platform, including disputes with other users.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Indonesia.
Any disputes shall be resolved in the courts of Kota Serang, Indonesia, unless otherwise mandated by law.

14. Amendments

Rekacipta.co.id may update these Terms from time to time. Users will be notified via email or platform announcements. Continued use of the Platform constitutes acceptance of updated Terms.
